Reinstatement After Revocation

Things can get much harder to navigate when reinstating after a revocation. Along with the requirements related to a driver’s license suspension, to reinstate you will need to schedule a Driver Assessment and Appeal Division (DAAD) hearing with the Michigan Secretary of State.

At this hearing, you will need to prove several things:

  • You are not struggling with or abusing drugs or alcohol
  • You understand the laws of the road and how best to follow them
  • You intend to follow all laws of the road
  • You are not on a path to relapse into substance abuse

Only one DLR hearing may be requested each year. If you do not receive approval at this hearing, you must wait one full calendar year to try again. It is crucial that you take all necessary steps to fully prepare for this hearing and provide as much evidence and proof of stability as possible. How to Prepare for Your Court Hearing

Before requesting a hearing, all paperwork must be submitted, including:

  • Substance abuse evaluation by a State Licensed Substance Abuse Counselor
  • 12-panel drug screen
  • Evidence to support your sobriety (AA meetings, treatment, medications)
  • Reference letters documenting sobriety (3-6 notarized letters)

Once these documents have been submitted, you will be notified if and when a hearing date is set, typically after about two to three months. Prior to the hearing date, we will thoroughly review potential questions asked of you, proving your commitment to sobriety.

The hearings are now conducted via video conferencing (Microsoft Teams). We will practice with you on accessing Microsoft Teams seamlessly, allowing you to feel comfortable logging into your hearing.

During the hearing, do not give answers to questions that are not directly asked of you, and speak slowly and purposefully.

What Is the Difference Between Suspension & Revocation?

Driver’s license suspension is the most common way the states will remove someone’s driving privileges. A judge can order this after a multitude of traffic violations or, if severe enough, an average nonviolent DUI arrest. Typically, a revocation will be reserved for when a driver has shown signs of a serious substance abuse issue. In some instances, this may require a driver to retake driver’s education courses and complete a driver’s test before even requesting a DAAD hearing to be scheduled.
